This website, available at drava.shop (the "Store"), is operated by DRAVA Spółka z o.o. (formerly DRAVA s.c.) ("Drava", "we", "us", "our"), a limited liability company established under the laws of Poland.

The Store is hosted on the Shopify Inc. e-commerce platform, which provides us with the technology to sell our products to you.
We are an authorised distributor of Peli™ / Hardigg™ protective cases and related equipment. Brand names, trademarks and certifications referenced in product listings belong to their respective owners.
2. Scope and acceptance
These Terms of Service ("Terms") govern your access to and use of the Store, and the sale of products by us to you. By browsing the Store, creating an account, or placing an order, you confirm that you have read, understood and accept these Terms.
These Terms apply to all users, whether you are acting as a consumer (a natural person purchasing for purposes outside your trade, business or profession) or as a business / professional buyer ("B2B"). Where a provision applies only to consumers or only to business buyers, this is stated expressly. Section 15 sets out the special rules for B2B sales.
These Terms are made available in English and in the other languages of the Store. The English version is the reference version; in the event of any discrepancy, the English version prevails, except where the mandatory consumer law of your country of residence provides otherwise. The contract may be concluded in English or in the language of the Store version you used to order.
If you do not accept these Terms, please do not use the Store.
3. Eligibility and age
To place an order you must be at least 18 years old and have the legal capacity to enter into a binding contract.
Some products in our catalogue (e.g. knives, machetes, certain protective and tactical equipment) are subject to statutory age limits, licensing or import restrictions that vary by country. By ordering such products you confirm that you meet all legal requirements in your country of delivery and use. See Section 12.
4. Products and descriptions
We make every effort to describe and depict our products accurately, including technical specifications, certifications (e.g. MIL-STD-810, IP ratings, STANAG, ATEX, ATA Spec 300 where stated) and dimensions. However:
- Colours and finishes shown on screen may differ slightly from the actual product due to display settings.
- Certifications and standards apply to the product as supplied by the manufacturer and are reproduced for information; they do not constitute an independent warranty by us beyond the statutory guarantee (Section 10).
- Made-to-order and customised items — including cases with custom-cut foam inserts, custom configurations, engraving or other personalisation — are produced to your specifications. Please see Section 11 for how this affects your right of withdrawal.
We reserve the right to limit quantities, discontinue products, or refuse or cancel an order where a product is unavailable, where a pricing or description error has occurred, or where we reasonably suspect fraud or a breach of these Terms. If we cancel an order you have already paid for, you will receive a full refund.
5. Prices, currency and VAT
- All prices are shown in euro (EUR) and include applicable VAT unless stated otherwise at checkout.
- Prices are subject to change, but the price applicable to your order is the price displayed at the moment you complete checkout.
- Consumers in the EU: prices are inclusive of Polish VAT or the VAT of your country of delivery, as applicable under EU distance-selling (OSS) rules. The VAT actually applied is shown at checkout.
- VAT-registered business buyers in the EU (intra-Community supply / WDT): to receive an invoice without Polish VAT, a valid EU VAT (VIES) number must be provided before the order is completed. A VAT number cannot be added or applied retroactively after the order is placed and paid.
- Orders shipped outside the EU (e.g. United Kingdom, Switzerland, Norway): the price at checkout does not include import duties, import VAT or carrier handling fees charged in the destination country. These are payable by you to the carrier or customs authority. Please review our page "Ordering from the UK & non-EU countries" for details.
6. Placing an order and contract formation
- You add products to your cart and complete the checkout, providing accurate billing, delivery and (where required) VAT information.
- After payment, you receive an automatic order confirmation by email. This confirmation acknowledges receipt of your order but does not by itself conclude the sales contract.
- The sales contract is concluded when we confirm dispatch of the products (or, for digital/made-to-order items, when we confirm we have begun fulfilment).
- We provide confirmation of the concluded contract, including these Terms, on a durable medium (by email) within a reasonable time and no later than delivery of the goods.
- We are not party to any code of conduct within the meaning of consumer-protection law, unless stated otherwise on the relevant product or information page.
- We may refuse or cancel an order as set out in Section 4. Where we limit or cancel, we will attempt to notify you using the contact details you provided.
7. Account registration
You can order as a guest or by creating an account. If you create an account:
- You are responsible for providing accurate information and for keeping your login credentials confidential. You are responsible for activity that occurs under your account, unless it results from our fault.
- Notify us promptly at biuro@drava.pl if you believe your account has been accessed without authorisation.
- You may close your account at any time by contacting us. We may suspend or close an account in case of breach of these Terms, suspected fraud, or where required by law. Closing an account does not affect contracts already concluded or statutory rights.
The processing of personal data associated with your account is described in our Privacy Policy (Section 17).
8. Payment
We accept the payment methods displayed at checkout, which currently include: American Express, Apple Pay, Bancontact, Google Pay, Klarna, Maestro, Mastercard, PayPal, Shop Pay, Union Pay and Visa. Card and payment data are processed by our payment providers over encrypted connections; we do not store full card numbers.
Where a third-party method (e.g. Klarna, PayPal) is used, that provider's own terms apply to the payment relationship between you and them.
9. Shipping and delivery
- Free shipping is offered for orders over €100 within the EU and over €250 outside the EU. Below these thresholds, shipping costs are calculated and shown at checkout.
- Estimated delivery times are indicative and not guaranteed unless agreed in writing.
- Risk of loss or damage passes to a consumer on physical delivery of the goods to you or a carrier you appointed (other than one we offered). For business buyers, risk passes on handover to the first carrier.
- For deliveries outside the EU, you are the importer of record and responsible for compliance with import rules, duties and taxes in the destination country (Section 5).
10. Legal guarantee of conformity, warranties and complaints
10.1 Statutory rights (consumers)
For consumers, products must conform to the contract. You benefit from the statutory legal guarantee of conformity under EU law (Directive (EU) 2019/771) and Polish law, with a minimum duration of two (2) years from delivery. Nothing in these Terms limits or excludes these mandatory rights. If a product is defective or not as described, you may be entitled to repair, replacement, a price reduction or a refund as provided by law.
10.2 Manufacturer / commercial warranties
Certain products carry an additional commercial warranty from the manufacturer (for example, Peli's guarantee on cases and torches). Such warranties are provided in addition to — and do not affect — your statutory rights. Warranty and repair handling for Peli products is described on our "Peli Service & Warranty Repairs" page.
10.3 How to complain and our response time
To report a defect or non-conformity, contact us at biuro@drava.pl with your order number and a description (and, where helpful, photos) of the issue.
For consumers, we will consider and respond to your complaint within 14 days of receiving it. If we do not respond within that period, your complaint is deemed accepted in accordance with Polish consumer law. This timeframe does not apply to B2B buyers (Section 15).
11. Right of withdrawal (consumers)
If you are a consumer, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, in accordance with Directive 2011/83/EU and Polish consumer law.
- The 14-day period runs from the day you (or a third party you indicate) take physical possession of the goods, or of the last item where an order is delivered in several parts.
- To exercise the right, send us an unequivocal statement of your decision to withdraw (by email to biuro@drava.pl or post). You may use the model withdrawal form set out in Annex 1 but are not obliged to.
- If you withdraw, we refund all payments received, including standard delivery costs, within 14 days of being informed, using the same payment method you used, unless you agreed otherwise. We may withhold the refund until we receive the goods back or you provide proof of return.
- You must return the goods without undue delay and in any event within 14 days. You bear the direct cost of returning the goods. You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions — important for our catalogue
The right of withdrawal does not apply to, among others (Art. 16 of Directive 2011/83/EU):
- goods made to your specifications or clearly personalised — this includes cases with custom-cut foam inserts, custom configurations and engraving;
- sealed goods which are not suitable for return for health-protection or hygiene reasons and were unsealed after delivery (where applicable).
Standard, non-customised catalogue products remain returnable within the 14-day period. For full details of returns and refunds, see our Refund Policy.
12. Restricted and regulated products
Part of our catalogue consists of equipment whose sale, possession, carriage, import or export is regulated and varies significantly between countries — including but not limited to ballistic and stab-resistant personal protective equipment, knives and machetes, gun cases, and certain tactical or lighting equipment.
By ordering such products you represent and warrant that:
- you are legally permitted to purchase, possess, import and use the product in your country of delivery and use;
- you meet any applicable age, licensing, permit or end-user requirements;
- you will not resell, re-export or transfer the product in breach of any applicable export-control, sanctions or customs law.
Age verification. For age-restricted items (such as knives and machetes) we may use age-verification measures at checkout or on delivery, and we may require proof of age before dispatch. We may refuse to fulfil an order where age cannot be satisfactorily verified.
Export control / dual-use. Some protective and tactical equipment may qualify as controlled or dual-use goods under EU Regulation (EU) 2021/821 or under national defence-trade rules. Where controls apply, fulfilment may require additional documentation (such as end-user information) and may be restricted or refused for certain destinations. You are responsible for obtaining any licence or authorisation required in your jurisdiction.
We may request additional documentation (e.g. proof of age, end-user or institutional credentials) before fulfilling an order, and may refuse or cancel any order we cannot lawfully fulfil. You are solely responsible for compliance with the laws of your jurisdiction. Where customs or authorities seize or refuse a shipment because of local restrictions you failed to observe, we are not liable for the resulting loss.
13. Intellectual property and use of the site
All content on the Store — text, product descriptions, photographs, graphics, logos and layout — is owned by us or our licensors and is protected by intellectual property law. You may not reproduce, copy, resell, scrape, or commercially exploit any part of the Store or its content without our prior written permission, except for normal browsing and ordering.
You agree not to use the Store: for any unlawful purpose; to infringe others' rights; to transmit malware; to harvest or track others' personal data; to spam, phish or scrape; or to interfere with the security or operation of the Store.
14. User submissions
If you send us reviews, ideas, suggestions or other materials ("Submissions"), you grant us a non-exclusive, royalty-free right to use, edit and publish them in connection with our business. You are responsible for your Submissions and confirm they do not infringe any third party's rights or contain unlawful or abusive content. We may, but are not obliged to, moderate or remove Submissions.
15. Business (B2B) buyers
Where you purchase in the course of a trade, business or profession:
- The consumer right of withdrawal (Section 11) does not apply.
- The statutory consumer guarantee regime (Section 10.1) does not apply; rights for defects are governed by the rules of the Polish Civil Code on sale between businesses, which may be modified or excluded as permitted by law. Unless otherwise agreed in writing, liability under rękojmia (warranty for defects) between businesses is excluded to the extent permitted by law, without prejudice to the manufacturer's commercial warranty.
- The 14-day complaint-response rule (Section 10.3) does not apply to B2B buyers.
- Our total liability to a business buyer for any order is limited, to the maximum extent permitted by law, to the value of the products ordered, and we are not liable for lost profits, lost data or indirect or consequential loss.
- Risk passes on handover to the first carrier (Section 9).
16. Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, for defective products under product-liability law, or for any other liability that cannot be excluded under mandatory law — in particular the statutory rights of consumers.
Subject to the paragraph above, we are not liable for loss or damage that was not reasonably foreseeable, that was not caused by our breach, or that arises from your failure to comply with the law of your jurisdiction (see Section 12). We do not warrant that the Store will be uninterrupted or error-free.
17. Personal data
We process your personal data in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy, which forms part of these Terms.
18. Out-of-court dispute resolution
If you are a consumer and a dispute cannot be resolved directly with us, you may be entitled to use an out-of-court alternative dispute resolution (ADR) procedure.
Please note that the EU Online Dispute Resolution (ODR) platform has been permanently discontinued as of 20 July 2025 (Regulation (EU) 2024/3228) and is no longer available. Consumers can instead find competent national consumer dispute-resolution bodies through the European Commission's consumer-redress information pages (consumer-redress.ec.europa.eu) and the Your Europe portal. In Poland, consumers may also seek assistance from the relevant Voivodeship Trade Inspectorate (Wojewódzki Inspektorat Inspekcji Handlowej) or a municipal/district consumer ombudsman (rzecznik konsumentów).
Use of ADR is voluntary; this clause does not affect your right to bring proceedings before a court.
19. Governing law and jurisdiction
These Terms and any sales contract are governed by the law of Poland. Where you are a consumer habitually resident in another EU/EEA country, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence (Article 6 of Regulation (EC) No 593/2008 — "Rome I"). Disputes are subject to the courts competent under applicable law; for consumers, this includes the courts of your place of residence where mandatory rules so provide.
20. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in the law or our operations. The version applicable to your order is the one in force when you place it. Material changes will be posted on this page with an updated "Last updated" date.
21. Severability and entire agreement
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in full effect. These Terms, together with our Refund Policy and Privacy Policy, constitute the entire agreement between you and us regarding your use of the Store.
