European drone law has a strange reputation: everyone agrees it's "harmonised", and almost everyone gets some part of it wrong. 🛸
The EASA framework — covering the EU, EEA countries and Switzerland — really is one of the most complete drone rulebooks in the world, and in principle one set of rules follows you from Lisbon to Lapland. In practice, the framework is layered: EU-wide categories and certificates on top, national geo-zones, insurance rules and enforcement underneath. That gap between "harmonised on paper" and "local in practice" is exactly where pilots get fined, grounded, or have a very bad morning at a checkpoint.
Here are the twelve rules pilots get wrong most often in 2026 — hobbyists and working pilots alike. One honest disclaimer before we start: drone law evolves, and details differ by country. Treat this as your map of the traps, then verify specifics with the national aviation authority of the country you're flying in before takeoff.
The paperwork traps 📄
1. "Under 250 g means no rules" — the most expensive myth in the hobby
A sub-250 g drone gives you real privileges: it can fly in the friendliest A1 subcategory, over uninvolved people (never over crowds), typically without a competency exam. What it does not give you is invisibility to the law. If your sub-250 g drone carries a camera — and virtually all of them do — you still must register as an operator, still must respect geo-zones, still fly under the 120 m ceiling, and still owe everyone on the ground basic privacy. Only camera-less toys under 250 g escape registration. The lightest drones enjoy the lightest rules — not the absence of rules.
2. Confusing operator registration with pilot certification
These are two different things, and mixing them up is the classic beginner's error. Operator registration is about who is responsible for the aircraft: you register once with your national aviation authority, receive an operator number, and that number must be displayed on every drone you fly. Pilot competency is about who's on the sticks: the A1/A3 certificate (an online theory exam) covers basic Open-category flying, and the A2 certificate adds the right to fly closer to people. One person can be both operator and pilot — but the system treats those roles separately, and inspectors check both.

3. Skipping the A1/A3 exam because "my drone is small"
The A1/A3 certificate is the entry ticket for flying anything with a C1 marking or heavier — and it's the easiest paperwork you'll ever do: a free or low-cost online course and test covering airspace basics, privacy and safety, valid for five years and recognised across all EASA states. Pilots skip it because their drone "is just a small one", then discover at 900 grams that they've been flying uncertified for a year. Do the exam once; it follows you around Europe.
4. Misunderstanding what the A2 certificate actually buys
The A2 Certificate of Competency is the serious credential — an additional proctored theory exam plus a declared practical self-training. What it buys is precise: with a C2-class drone, you may operate as close as 30 metres horizontally from uninvolved people, reducible to 5 metres in low-speed mode. What it does not buy: flying over people (that stays an A1/C0-C1 privilege), flying over crowds (nobody may), or ignoring geo-zones. Urban and real-estate shooters need A2 constantly; landscape pilots may never need it at all.

5. Reading "120 m" as height above takeoff
The Open-category ceiling is 120 metres above ground level — the ground directly below the drone, not above your launch point. Launch from a clifftop and fly out over the valley, and your "legal" 100 m altitude reading can become 300 m above the terrain below. In the mountains this rule bites constantly (there's a slope-following provision when flying close to terrain features, but the principle stands): think in terms of the ground under the aircraft, not the ground under your feet.
6. Treating "a few people" and "an assembly" as the same thing
EU rules distinguish sharply between uninvolved individuals (a person walking through your frame — briefly overflyable with C0/C1 in A1) and assemblies of people (concerts, beaches in season, markets, demonstrations — where density means individuals can't move away). No Open-category drone may overfly an assembly, ever, at any weight. The festival shot from directly above is not a grey area; it's the fastest route to losing your drone and gaining a fine.

7. Assuming geo-zones look the same in every country
Here's where "harmonised" ends. The categories and certificates are EU-wide; the map of where you may actually fly is national. Each country defines its own geo-zones — airports, cities, nature reserves, government areas — and publishes them in its own official app or map, in its own format. The zone logic that's second nature at home (your national app, your buffer distances) simply doesn't transfer; a location that's fine in one country can be a protected zone across the border. First step in any new country: find the official national drone map, not a third-party app's guess.
8. Flying uninsured because "the EU doesn't require it"
Insurance is the sleeper rule. EU-level law leaves hobby-drone insurance largely to member states — and several of them require liability insurance for every drone flight, full stop, while others require it only above weight thresholds or for commercial work. Pilots from no-mandate countries land on holiday, fly legally in every other respect, and are uninsured in a country where that's an offence. Specialist drone liability policies cost little; check the requirement for every country on your itinerary, and remember a claim from an injured bystander can dwarf any fine.

9. Flying FPV without a spotter
The Open category requires visual line of sight — and by definition, goggles break it. The EU's answer: FPV is treated as flight with visual aids and requires an observer standing next to you who maintains direct VLOS with the aircraft throughout the flight. Solo FPV sessions in a public park are one of the most commonly broken rules in the entire framework. Bring a friend; the rule is inconvenient and also not optional.
10. Expecting home-built and legacy drones to enjoy class-mark privileges
The C0–C4 class-marking system is what unlocks the friendly subcategories — and it applies to drones certified and sold as such. Privately built drones can't carry a class mark, which pushes anything home-built over 250 g into A3 territory: at least 150 metres from residential, commercial, industrial and recreational areas. The same restrictive logic has applied to unmarked "legacy" drones under transitional provisions. If you fly self-built quads, plan around A3 distances — a 400 g custom build is legally closer to a 20 kg rig than to a shop-bought 900 g camera drone.

11. Believing one registration and one certificate mean zero homework abroad
The good news is real: you register as an operator in one EASA country (your residence), your certificates enjoy mutual recognition, and no member state may demand you re-register. The trap is concluding that nothing else varies. National geo-zones (rule 7), insurance mandates (rule 8), local restrictions on night operations or nature reserves, and — outside the EASA zone — entirely different regimes all still apply. 12. Forgetting that the drone must be inspection-ready — not just the pilot
When an inspector or police officer takes an interest, the conversation covers more than your app: is the operator number legibly displayed on the airframe? Is the class mark visible? Remote ID broadcasting (required on C1 and up)? Firmware and geo-awareness current? Documents — registration, certificate, insurance where required — accessible on your phone?
